Kentucky Fights Back Against ACLU’s Challenge to Abortion Ban

Kentucky is standing firm in defense of its near-total abortion ban, as the ACLU begins its legal challenge to overturn the law. The ACLU represents a woman, “Mary Poe,” who traveled out of state to have an abortion after Kentucky’s Human Life Protection Act (HLPA) took effect in 2022. The law criminalizes most abortions, except when necessary to save the mother’s life.

The ACLU is seeking to expand the case into a class-action suit on behalf of all pregnant women in Kentucky. The first hearing took place on November 18, 2024, with Judge Tracey Davis presiding. Kentucky’s Attorney General, Russell Coleman, is vigorously defending the law, with pro-life advocates praising the state’s legal team. The case’s future will be determined in January 2025, when Judge Davis is expected to rule on whether to allow the class-action expansion.
